The Child Brain Injury Trust

The Child Brain Injury Trust was established by a group of health professionals in 1991 to research and provide information regarding the effects of ‘traumatic’ injury on a child’s developing brain.

The Spinal Injuries Association (SIA) is the leading national, user-led spinal cord injuries charity.

The Society of Clinical Injury Lawyers (SCIL)

The Society of Clinical Injury Lawyers was established in 2013 as an organisation to represent the views of its members, clinical injury lawyers working with those who are claiming compensation for the effects of clinical negligence.

Our Partnerships

To this end we have established a number of joint ventures with partners who share our values, bringing our services to an ever-growing customer base.

Aspire+ Wealth Management

In partnership with spinal chord injury charity Aspire, Frenkel Topping operates the joint venture Aspire+ Wealth Management. Through the partnership, FT is the preferred partner to provide Aspire’s service user base with post-settlement investment advice, an often-essential service after a life changing event. Every four hours someone in the UK is paralysed by spinal cord injury and a large majority are permanent wheelchair users for the rest of their lives.

HCC Investment Solutions

HCC Investment Solutions, a 50/50 joint venture between Frenkel Topping and Horwich Cohen Coghlan Ltd (HCC), a law firm with a 25 year track record specialising in personal injuries, develops new and innovative investment products for the personal injury market. The joint venture also supports Ascencia Investment Management to create bespoke investment solutions and support future assets under management growth.

ExpressFT Ltd

ExpressFT Ltd is a 50/50 joint venture between Frenkel Topping and Manchester-based, top 200 solicitor Express Solicitors, a specialist in personal injury. As part of the joint venture, Frenkel Topping Limited is a preferred IFA to offer expert post-settlement advice to Express’s clients who have suffered from personal injury and clinical negligence.

Hudgells Financial Management Services

Thanks to this joint venture with Hudgell Solicitors, a leading law firm specialising in personal injury, medical negligence, travel litigation, civil liberties and abuse, FTL is Hudgell’s preferred partner for clients who require investment advice post settlement. The joint venture is expected to bring synergies and support future growth for both businesses. Hudgells Financial Management Services provides Hudgell with an additional pillar to the business and a value-added service to meet the needs of the most complex client.

Fletchers Financial Investment Solutions

In partnership with Southport-based Fletchers Solicitors we aim to provide the highest quality financial service advice, support and recommendations, predominantly to the recipients of medical negligence and personal injury awards. We provide advice to customers at the pre-settlement stage, financial guidance following the settlement of claims, and ensure customers are able to achieve their goals, aims and needs following what is often a life-changing event.

Our commitment to the PFS Financial Vulnerability Taskforce

The Financial Vulnerability Taskforce is a newly created independent representative body covering the Personal Finance Sector whose ultimate purpose is to promote greater understanding, encourage appropriate behaviours and establish good practice in respect of consumer vulnerability.

The Financial Vulnerability Charter acts as an informed source of positive influence on both policymakers, professionals and the general public alike to ensure that professionals working across the Personal Finance Sector are increasingly seen as a ‘safe pair of hands’, especially by those who find themselves in vulnerable circumstances.

As professionals working in or with the UK Personal Finance Sector:

  1. We acknowledge that as our services often involve the application of specialist and technical financial knowledge, this places many clients in a position of dependency and as such imposes upon us a greater moral duty to act in their best interests and as a ‘safe pair of hands’ , especially to those who find themselves in vulnerable circumstances.
  2. We accept that our professional obligation to use ‘best endeavours’ and place our clients’ interests above our commercial interests have a greater significance to clients who are in vulnerable circumstances and, therefore, at greater risk of detriment.
  3. We recognise that vulnerability can manifest itself in either physical, mental or emotional form (knowingly or otherwise), is dynamic in nature (short lived or longer term, sometimes permanent, transient, recurring or fluctuating over time) and may be hidden.
  4. When working with clients who seek to access our services, we treat all fairly, regardless of their identity, age, gender, race, sexual orientation, disability, gender reassignment, religion or belief, and guard against making assumptions about individuals.
  5. We believe that language and terminology is important. Vulnerability relates to circumstances and not a category of person. As such, descriptions such as ‘those in vulnerable circumstances’ should be used at all times instead of ‘vulnerable individuals’, except when only referring to individuals or groups of individuals where vulnerability is permanent.
  6. We recognise that people in vulnerable circumstances are often unaware of their vulnerability and, if they are aware, might not acknowledge it nor wish to be described as vulnerable. We, therefore, accept our heightened professional obligations towards clients in vulnerable circumstances; and the need for raised awareness, greater sensitivity, and additional technical competencies.
    • We seek to recognise clients in vulnerable circumstances and encourage all to self-declare if appropriate, safe in the knowledge that we will:
    • Adapt our business processes and professional services, so our clients do not suffer detriment at any point as we seek to deliver outcomes at least as good as for those who are not in vulnerable circumstances.
    • Maintain confidentiality and ensure our behaviours are fully compliant with all relevant legislation including The Equality Act (2010), Consumer Protection regulations, The Mental Capacity Act 2005 and data protection including GDPR.
    • We see application of the above as ‘business as usual’, part of our raison d’être and not part of a separate compliance or ‘stand-alone’ exercise.
  7. We seek to enable all members of our organisations to deal compassionately, empathetically and effectively with those in vulnerable circumstances by raising awareness of vulnerability and by providing training to all within our organisations in appropriate methods of engagement and the effective discharge of our professional services.
  8. When we encounter clients in vulnerable circumstances and recognise that they may be in immediate danger of significant abuse or harm, or may need immediate support, we will take action to contact the appropriate authorities to mitigate the risks they face.
